Many people mistakenly think that a personal injury needs to have a clear person to blame. For example, a car accident could be the fault of another driver, or a medical malpractice lawsuit might be the fault of the doctor. But there are many times when an injury could be considered for a personal injury lawsuit even though most people might think it was just their bad luck.

While it is true that accidents happen, most of the time they happen due to the negligence of someone else. Even the most simple of accidents, slips and falls, can happen because someone had failed to make the area safe. It is your right to be able to assume that the areas you walk on are safe to do so. Generally speaking, the law agrees.

There are many examples of personal injuries where a personal injury lawyer could successfully argue that the victim should receive some form of compensation. Construction site injuries are a good example. Whereas most construction workers are aware that their jobsite is dangerous, the pedestrians near it may not be.

Here is an example of that. There was once a case of a woman dying from an event that happened on a construction site that was miles away. One of their machines malfunctioned and launched through her apartment, killing her. The employees on the site were not injured but the poor woman, having nothing to do with the site, did not survive. Her family could have considered the event a freak accident, but they realized that her death was due to the negligence of the construction site.

In terms of slips and falls there are those where the blame is easier to spot than others. If you are in a grocery store and you slip and fall on a wet floor, most likely you will associate the grocery store with some sort of blame for that. What do you do if you slip and fall on a sidewalk though?

Even on a sidewalk, someone was responsible for maintaining the safety of that walkway. It can be assumed that it is a safe place to walk because it is a sidewalk. You falling and hurting yourself is not your fault, and the person or entity that failed to maintain it should help you recover.

Personal injury law is a complicated form of law that has many facets. You cannot simply assume that your accident is not able to be considered in a personal injury case.
