Truck Co. Stuck with $2.1 Million for Damages
Last week, a Tennesse judge awarded a woman almost $2.14 million in damages for injuries. The woman was injured after a YRC Inc truck driver rear-ended her. Sylvia Stephenson, the plaintiff was willing to settle outside of court for the damages she obtained from the negligent trucking company. The settlement was around $1.6 million. Needless to say, YRC should have taken the deal. Stephenson argued that YRC was negligent in keeping their driver on the road, given his questionable driving history. Charles Pridemore was the driver that rear-ended Stephenson. Pridemore has had a history of traffic violations and had a suspended commercial license at the time of the accident.
The accident happened when Stephenson put on her breaks to allow another truck to pass her. This is when Pridemore, who was alleged to be following to close, slammed into Stephenson with his double tractor-trailer. YRC claimed that the accident would not have happened if Stephenson didn’t break. Since she did, she was 50% responsible. Under Tennessee law, this means she would not be eligible for damages. However, the jury did not see it this way. The $2.1 million in awards has now been sent to the judge, where it awaits approval.
