Rideshare drivers are trusted with people who are often alone, tired, or have been drinking. Passengers in Colorado Springs ride home from downtown bars, Fort Carson, the airport, and campus. Most rides are safe. But when a driver crosses the line, the harm can last for years.
Rideshare sexual misconduct can include:
- Rape and attempted rape
- Unwanted touching or groping
- Kidnapping, or driving off the route against your wishes
- Indecent exposure or sexual comments
- Stalking or contact after the ride
- Recording or photographing a passenger without consent
Assaults by someone posing as a rideshare driver can also lead to a claim. If you were hurt in a crash instead, see our Colorado Springs rideshare accident page.
What to Do After a Rideshare Sexual Assault
Your safety comes first. Go somewhere safe and call 911 if you are in danger. When you’re ready, these steps can protect your health and your options:
- Get medical care. A hospital can treat injuries and collect forensic evidence. In Colorado, you can get a forensic exam even if you are not ready to report to police, and you are not billed for the exam itself (C.R.S. 18-3-407.5).
- Save the ride details. Screenshot the trip receipt, route map, driver name, and license plate in the app.
- Keep messages. Save any texts or in-app messages with the driver.
- Report it if you choose. You can report to the police and to the rideshare company. Uber and Lyft both take safety reports in the app or online (Uber, Lyft). Keep a copy of what you send.
- Get support. In Colorado Springs, TESSA offers a free, confidential 24/7 Safeline at (719) 633-3819. The National Sexual Assault Hotline is 1-800-656-4673.
- Talk to a lawyer before you talk to an insurer. Rideshare companies have their own investigators.
There is no wrong way to respond after an assault. If you didn’t do some of these things, you may still have a strong case.
Can You Sue Uber or Lyft for a Driver's Assault?
Often, yes. A claim against the driver alone may not pay much. A claim against the company can. Uber and Lyft may be responsible when they:
- Fail to screen drivers or miss red flags in their records
- Keep drivers on the app after earlier complaints
- Fail to use available safety tools, like better monitoring or dash cameras
- Market their rides as safe while knowing about assault risks
Thousands of survivors have already sued. As of November 2, 2026, more than 4,500 lawsuits against Uber were pending in one federal case in San Francisco (U.S. Judicial Panel on Multidistrict Litigation). In February 2026, a federal jury in Phoenix ordered Uber to pay $8.5 million to a passenger who was assaulted by a driver (NBC News). Lyft sexual assault cases were also combined in their own federal proceeding in 2026. Colorado survivors can bring claims too.
Who Else May Be Responsible?
The driver is always responsible for the assault. Depending on the facts, a bar, hotel, apartment owner, or venue with poor security may share the blame too.
Colorado Laws for Rideshare Sexual Assault Claims
No Time Limit for Sexual Misconduct Claims
Colorado removed the civil filing deadline for sexual misconduct. For claims that arose on or after January 1, 2022, and older claims whose deadline had not run by then, you can file at any time. That applies to adult and child survivors, and to claims against the abuser or a third party like an employer, business, or organization (C.R.S. 13-80-103.7, SB21-073). Older childhood abuse claims follow different rules, so talk to a lawyer about your dates.

Colorado Rideshare Safety Rules
Colorado requires rideshare companies to run criminal background checks, including the national sex offender database. A person with an offense involving unlawful sexual behavior can never drive for them (C.R.S. 40-10.1-605). A 2026 law adds background checks every six months starting in 2027, required review of drivers after complaints, and safety training (HB26-1424). When a company breaks these rules, that can help prove it was negligent.
Damages and Punitive Damages
For claims arising on or after January 1, 2025, damages for pain, suffering, and emotional distress are capped at $1.5 million. Medical costs and lost wages are not capped (HB24-1472, C.R.S. 13-21-102.5). When a defendant acted willfully and wantonly, a court can also award punitive damages, generally up to the amount of your actual damages (C.R.S. 13-21-102).
Compensation for Rideshare Sexual Assault Survivors
A civil claim can’t undo what happened. It can pay for the help you need and hold the company accountable. Compensation may include:
- Medical care, including emergency and follow-up treatment
- Counseling and therapy, now and in the future
- Lost wages and lost earning ability
- Pain, suffering, and emotional distress
- Punitive damages in some cases, to punish reckless conduct
Every case is different. We look at your full story and fight for what your case is truly worth.
Will My Case Stay Private?
We protect your privacy at every step. Your consultation is confidential. In many cases, courts allow survivors to file under initials or a pseudonym, and many cases settle privately without a trial. We’ll explain your options before anything is filed, and nothing moves forward without your OK.
Will I Have to Go to Court?
Most civil cases settle before trial. If yours does go to court, we will prepare you for every step and stand beside you.

Frequently Asked Questions:
Uber & Lyft Sexual Assault FAQs
How can I sue Uber or Lyft after a sexual assault?
Start by talking with a lawyer who handles rideshare sexual assault claims. Your lawyer gathers the ride records and evidence, then files a civil claim against the driver and, when the facts support it, the rideshare company. Many Uber cases are filed in a federal case in San Francisco, but a Colorado lawyer can explain where your claim belongs. Call 719-779-0090 for a free, private consultation.
Do I qualify for an Uber or Lyft sexual assault lawsuit?
You may qualify if a driver sexually assaulted, groped, harassed, or kidnapped you during or after a ride booked through the app. You do not need to have reported to police, and there is no Colorado filing deadline for sexual misconduct claims that arose on or after January 1, 2022. A free consultation is the fastest way to find out.
Can I sue Uber for emotional distress?
Yes. Emotional distress, anxiety, PTSD, and the cost of counseling are often the largest part of a sexual assault claim. Colorado caps these noneconomic damages at $1.5 million for claims arising on or after January 1, 2025.
How much is a rideshare sexual assault lawsuit worth?
Every case is different. Value depends on what happened, your medical and counseling needs, lost income, and the evidence against the company. In February 2026, a federal jury ordered Uber to pay $8.5 million to one survivor, but past results do not guarantee any outcome.
Has Uber settled sexual assault lawsuits?
Some individual cases have settled, often confidentially. As of November 2026, Uber had not agreed to a global settlement, and thousands of cases remained pending. We can explain the current status during your consultation.
Will my name be made public?
We do everything we can to protect your privacy. Your consultation is confidential, courts often allow survivors to file under initials or a pseudonym, and many cases settle privately.
What if I didn't report the assault to police?
You can still bring a civil claim. Reporting to police is your choice. Ride records, messages, medical records, and witness statements can all help prove what happened.
How much does a rideshare sexual assault lawyer cost?
Nothing up front. The Law Giant works on a contingency fee, so you pay only if we recover money for you. The first consultation is free and private.
