A criminal case is brought by the district attorney to punish the offender. A civil case is brought by you, to get compensation and hold everyone responsible accountable. You can file a civil claim even if:
- You never reported the assault to police
- Prosecutors declined to file charges
- The accused was found not guilty
- The assault happened years ago
Civil cases use a lower standard of proof than criminal cases. And a civil claim can reach the organizations that enabled the abuse, which often have the insurance to pay for your recovery.
Types of Sexual Assault and Abuse Cases We Handle
We represent survivors of abuse in many settings, including:
- Assaults at apartment complexes, hotels, bars, and parking lots with poor security
- Abuse by employers, supervisors, or coworkers
- Abuse by doctors, therapists, massage therapists, and caregivers
- Abuse in schools, daycares, youth sports, and camps
- Abuse by clergy or church volunteers
- Uber and Lyft sexual assault by rideshare drivers
- Abuse of seniors in care facilities (see our nursing home abuse page)
Who Can Be Held Responsible?
The person who committed the assault is always responsible. Others may share liability when they failed to protect you, such as:
- Property owners who ignored broken locks, bad lighting, or past crimes (see premises liability)
- Employers who hired or kept a dangerous worker
- Schools, churches, and youth groups that ignored warning signs
- Medical practices and care facilities that failed to supervise staff
- Companies that failed to screen or monitor workers, like rideshare apps
How The Law Giant Builds Your Case
We gather police and medical records, past complaints, hiring files, security video, and witness statements. We work with trauma-informed experts to show how the assault has affected your life. You will not have to retell your story more than necessary.
First Steps After a Sexual Assault

If you are in danger, call 911. When you’re safe, consider these steps:
- Get medical care. A hospital can treat injuries and collect evidence. In Colorado, you can get a forensic exam even if you are not ready to report to police, and you are not billed for the exam itself (C.R.S. 18-3-407.5).
- Get support. In Colorado Springs, TESSA offers a free, confidential 24/7 Safeline at (719) 633-3819. The National Sexual Assault Hotline is 1-800-656-4673.
- Write down what you remember when you feel able: dates, places, names, and anyone you told.
- Save evidence like texts, messages, photos, and clothing.
- Talk to a lawyer before you talk to an insurer or an institution’s investigator.
There is no right or wrong way to react. Many survivors wait months or years to come forward, and that does not mean your case is weak.
Colorado Sexual Assault Civil Claim Laws
No Time Limit for Sexual Misconduct Claims
Colorado removed the civil filing deadline for sexual misconduct. For claims that arose on or after January 1, 2022, and older claims whose deadline had not run by then, you can file at any time. That applies to adult and child survivors, and to claims against the abuser or a third party like an employer, business, or organization (C.R.S. 13-80-103.7, SB21-073). Older childhood abuse claims follow different rules, so talk to a lawyer about your dates.

Claims Against Public Schools and Agencies
Claims against a public entity, such as a public school district, may require written notice within 182 days and may have damage limits (C.R.S. 24-10-109 and 24-10-114). If a public institution may be involved, call a lawyer quickly.
Damages and Punitive Damages
For claims arising on or after January 1, 2025, damages for pain, suffering, and emotional distress are capped at $1.5 million. Medical costs and lost wages are not capped (HB24-1472, C.R.S. 13-21-102.5). When a defendant acted willfully and wantonly, a court can also award punitive damages, generally up to the amount of your actual damages (C.R.S. 13-21-102).
Compensation for Sexual Assault Survivors
A civil claim can pay for the care and support you need. Compensation may include:
- Medical treatment and medication
- Counseling and therapy, now and in the future
- Lost wages and lost earning ability
- Pain, suffering, and emotional distress
- Loss of enjoyment of life
- Punitive damages in some cases
No amount of money erases what happened. But a fair recovery can give you stability, access to care, and a measure of justice.
Will My Case Stay Private?
Your privacy matters to us. Everything you share in your consultation is confidential. Courts often let survivors file under initials or a pseudonym, and many cases settle privately without a public trial. We’ll explain every option, and nothing happens without your approval.
Will I Have to Face the Abuser in Court?
Most civil cases settle before trial. If yours does not, we prepare you for each step and are by your side the whole way.
When Should You Call a Sexual Assault Lawyer?
Call when you’re ready. It is often better to call sooner, because evidence like video and records can disappear and some deadlines are short, especially for claims against public schools or agencies. A call is not a commitment. It’s a chance to learn your options.
The consultation is free and private, and there is no fee unless we win. Call 719-779-0090 or contact us online.

Frequently Asked Questions:
Colorado Springs Sexual Assault Claim FAQs
What type of lawyer is best for a civil sexual assault case?
A personal injury lawyer who represents survivors in civil sexual assault and abuse cases. A criminal defense lawyer represents the accused, and the district attorney handles criminal charges. A civil lawyer works for you and seeks compensation from the abuser and any institution that failed to protect you.
What is the statute of limitations for a sexual assault lawsuit in Colorado?
For sexual misconduct claims that arose on or after January 1, 2022, and older claims whose deadline had not passed by then, there is no time limit in Colorado (C.R.S. 13-80-103.7). Older childhood abuse claims follow different rules, and claims against public entities may need notice within 182 days, so talk to a lawyer about your dates.
How much is a sexual assault lawsuit worth?
It depends on the harm you suffered, the cost of counseling and medical care, lost income, and who can be held responsible. Claims against businesses and institutions often have more insurance than claims against an individual. Colorado caps noneconomic damages at $1.5 million for claims arising on or after January 1, 2025, and punitive damages may be available.
Can I sue for emotional distress in Colorado?
Yes. Emotional distress, anxiety, depression, and PTSD are recoverable damages in a Colorado sexual assault claim, along with the cost of therapy and lost income.
How much does a lawyer cost for a sexual assault case?
For survivors, nothing up front. The Law Giant works on a contingency fee, so you pay only if we recover money for you. The consultation is free and confidential.
Can I sue if the abuser was never charged with a crime?
Yes. A civil case is separate from a criminal case and uses a lower standard of proof. You can bring a civil claim even if no charges were filed or the accused was found not guilty.
Can I sue the business or organization where it happened?
Often, yes. Property owners, employers, schools, churches, and care facilities can be responsible when they ignored warning signs, failed to provide reasonable security, or kept a dangerous person in a position of trust.
Will my case stay private?
We protect your privacy at every step. Your consultation is confidential, courts often allow survivors to file under initials or a pseudonym, and many cases settle privately without a public trial.
