Union Pacific Railroad Worker Awarded $5M

This Monday, a Las Vegas jury returned a $5 million verdict in favor of an injured worker. Greg Gibbson was a truck driver for Union Pacific railroads, driving a truckload of UPR equipment. According to the lawsuit, UPR converted an old covered railcar into a bridge. While it’s unusual, it certainly isn’t illegal. As long as they did the proper safety test, there shouldn’t be a problem. However, UPR failed to do this, resulting in the harm of their worker. The mega logistics company was already cutting costs using an old railcar as a bridge. The least they could do is make sure it was safe. The fact they didn’t was made abundantly clear after Gibson’s truck came crashing down into a ravine.

The “bridge” collapsed underneath him. Gibbson was rushed to the hospital. He later underwent a cervical fusion procedure to his neck. Needless to say, this was a very complex and expensive procedure, causing Mr. Gibbson a massive amount of pain. Gibbson sued Union Pacific under the Federal Employer’s Liability Act (FELA). It was clear that UPR failed to maintain the bridge, that they improperly converted to save money.

Union Pacific claims that the crash was not severe enough to cause Mr. Gibbsons injuries, which consisted of back pain, herniated discs, and other neck issues. Keep in mind, that this several ton truck, fell into a ravine. The fact of the matter is that Mr. Gibbson is lucky that those were his only injuries. The situation could have been much worse. The jury agreed. They unanimously delivered their $5 million verdict in favor of Mr. Gibbson.
