McAllen Reckless Driving in Short
- Speed is a leading cause of serious crashes in McAllen. The City’s plan ties it to 29% of fatal and serious-injury crashes.
- Most serious crashes happen on 30 to 45 mph streets. Busy arterials, not just highways, are where people get hurt.
- Half of Hidalgo County’s 2025 traffic deaths involved speeding. TxDOT counted 26 of 52.
- You can recover even if you were partly at fault. Your share must be 50% or less.
What McAllen’s Safety Plan Found
The McAllen Vision Zero Action Plan studied crashes from 2018 to 2023. It found that failure to control speed was a factor in 29% of fatal and serious-injury crashes, and that 83% of those crashes happened on streets with speed limits of 30 to 45 mph.
The plan named some of the city’s highest-risk intersections, including Pecan Boulevard at North 21st Street, Nolana Avenue at North 10th Street, and Expressway 83 at 16th Street.
When the Insurer Says It Was Your Fault
Even after an obvious reckless driving crash, insurers often argue that the injured person shares the blame, for example for turning, braking or not seeing the other car. Texas uses proportionate responsibility:
- You can recover if your share of fault is 50% or less, under § 33.001
- Your recovery is reduced by your percentage of fault, under § 33.012
- Each driver’s share is decided by the jury, or negotiated in a settlement
Speed evidence is often what shifts the blame back where it belongs. A driver going far over the limit leaves no time for anyone else to react.
