Hidalgo County drownings happen in backyard and apartment pools, and also in canals that carry irrigation water across the Valley. Each setting has different rules about who is responsible.

McAllen Drowning Claims in Short
- Most recent Hidalgo County child drownings happened in pools. State records list apartment and backyard pool deaths in 2024 and 2025.
- McAllen runs five public pools. Claims against a city pool follow the Texas Tort Claims Act.
- Irrigation canals are a separate hazard. Many are owned by irrigation districts, which are government bodies with special rules.
- Apartment pools must meet state fence rules. A missing latch or broken gate can show negligence.
Hidalgo County Drowning Records
The Texas Department of Family and Protective Services lists child drownings by county. In Hidalgo County, it recorded two in 2024, one at an apartment pool and one at a backyard pool, and one in a backyard pool in 2025.
The numbers are smaller than in big cities, but each case involves the same questions: was the pool fenced, did the gate latch, and was anyone responsible for watching?
McAllen’s Public Pools
McAllen’s budget describes five public pools, two of them open eleven months a year, used for public swimming and McAllen ISD’s Learn-to-Swim program. The City has also set a goal of increasing lifeguard outreach.
Swimming pools are a governmental function under the Texas Tort Claims Act. A claim against the City usually requires written notice within six months, and a city’s liability is capped at $250,000 per person.
Apartment and HOA Pools
Shared pools must meet Texas Health and Safety Code Chapter 757: a 48-inch enclosure, self-closing and self-latching gates, and inspections at least every 31 days.
Canals and Other Valley Waterways
The Valley’s irrigation canals can be deep and fast, and they are often close to homes. In May 2026, KRGV reported on a teen’s drowning in a canal near Mercedes owned by an irrigation district, and on questions about security at the site.
Irrigation districts are government bodies, so claims against them can involve immunity, short notice deadlines and damages caps. Landowners next to a canal may have separate duties. These cases need prompt legal review.
What Your Family Can Recover
A near-drowning can cause lasting brain injury from lack of oxygen. A claim can cover medical care, therapy, future care needs, lost earning ability, pain and mental anguish. After a death, the family may bring a wrongful death claim under § 71.002.

Common Questions
McAllen Pool Drowning FAQs
Can I sue if my child drowned in an irrigation canal?
Possibly, but these cases are hard. Many canals belong to irrigation districts, which are government bodies with immunity protections and short notice deadlines. Nearby landowners may also have duties. Talk to a lawyer quickly.
Who pays after a drowning at a McAllen apartment pool?
Usually the apartment owner’s liability insurer. State law requires shared pools to have a 48-inch fence, self-latching gates and monthly inspections, and an owner who ignores those rules can owe damages.
What should I do after a near-drowning?
Get medical care right away, even if the child seems fine, because breathing problems can develop later. Take photos of the pool, gate and fence, write down witness names, and do not give a recorded statement to an insurer before talking to a lawyer.
How long do I have to file a drowning claim?
Most claims must be filed within two years under § 16.003. Claims against a city or irrigation district usually need written notice within six months, or sooner.
